Data Use Policy

1. Purpose
This Data Use Policy explains how customers may use data, enrichment results, API responses, exports, reports, and other outputs obtained through LeadMagic Services. It is incorporated into our Terms of Service and should be read together with our Acceptable Use Policy, and our International Use Notice.
2. Customer Responsibility
You are solely responsible for determining whether and how you may lawfully use, contact, enrich, import, export, store, combine, disclose, sell, share, or otherwise process data obtained through the Services. LeadMagic provides business data tools and enrichment outputs; LeadMagic does not provide legal advice, campaign approval, consent management, suppression-list management for your systems, or compliance clearance for your outreach or downstream use.
You must maintain your own lawful basis, notices, consent records, opt-out processes, unsubscribe mechanisms, suppression lists, and vendor/customer contract terms as required for your use case and jurisdiction.
If you use the Services or outputs outside the United States, you are also responsible for local restrictions on B2B marketing, electronic communications, telemarketing, cookies, data transfers, professional contact data, and database licensing in each country where you operate or target recipients.
3. Permitted Use
Unless your plan, order form, or written agreement states otherwise, you may use LeadMagic outputs only for your internal business purposes, including B2B sales, marketing, analytics, account research, enrichment, verification, and CRM maintenance. You may share outputs with your employees, contractors, and service providers only as reasonably necessary for your internal business use and only if they are bound by confidentiality and use restrictions at least as protective as these terms.
4. No Consumer Reports or Regulated Decisions
LeadMagic outputs are not consumer reports and may not be used to determine a person's eligibility for credit, insurance, employment, housing, lending, tenant screening, education, healthcare, criminal justice, government benefits, or any other purpose regulated by the Fair Credit Reporting Act or similar laws. You may not use the Services to make legal, similarly significant, or high-impact decisions about individuals.
5. Restricted Data and Sensitive Uses
You may not use the Services to request, upload, infer, target, or process:
- Payment card data, bank credentials, passwords, or authentication secrets
- Government identifiers or regulated identity documents
- Health, biometric, genetic, children's, or precise location data
- Data revealing race, ethnicity, religion, politics, union membership, or sexuality
- Data for unlawful spam, stalking, doxxing, discrimination, harassment, or fraud
6. No Resale or Redistribution
You may not sell, resell, publish, sublicense, syndicate, transfer, disclose, or redistribute LeadMagic data, enrichment outputs, exports, API responses, or derived datasets except as expressly permitted in a written agreement signed by LeadMagic. You may not use the Services to build, train, benchmark, enhance, or operate a competing product, data broker service, enrichment service, people-search service, or lead database.
7. Data Accuracy and Verification
LeadMagic outputs may be incomplete, outdated, duplicated, incorrectly matched, or otherwise inaccurate. You must independently verify important information before using it, especially before contacting a person, importing records into production systems, making business decisions, or relying on an output for compliance-sensitive workflows.
8. Suppression and Opt-Outs
You are responsible for honoring opt-outs, unsubscribe requests, suppression requests, do-not-call obligations, and similar restrictions in your own systems and campaigns. If LeadMagic provides suppression indicators, opt-out information, or deletion notices, you must promptly apply them where required by law or contract.
9. Monitoring and Enforcement
We may monitor usage for security, billing, platform integrity, abuse prevention, legal compliance, and policy enforcement. If we reasonably believe your use violates this Policy, our Terms, applicable law, payment obligations, or third-party rights, we may throttle, suspend, or terminate access; disable API keys; revoke credits; block exports; stop jobs; require remediation; or take other steps we reasonably determine are necessary to protect LeadMagic, the Services, data subjects, customers, or third parties.
